Welcome to T&T Handyman Services LLC!
By accepting the estimate and allowing us to begin work on your project, you agree to the following terms and conditions. These terms take effect immediately upon acceptance of the estimate. If you have any questions or concerns, please contact us before the estimate is accepted. Once the job is completed and an invoice is provided, these terms will remain in effect. If you do not agree with any part of these terms, please inform us before accepting the estimate so we can address your concerns.
1. Service Engagement
Scope of Work: T&T Handyman Services LLC offers a variety of handyman services, as detailed in our service offerings. The scope of work for each project will be clearly outlined in estimates.
Estimates: Estimates are based on the information available at the time of assessment. Actual costs may vary due to unforeseen circumstances or additional services required.
2. Payment and Invoicing
Labor and Material Costs: All estimates provided cover labor costs only. Materials are billed separately, and the final invoice will include both labor and material costs.
Payment Terms: A deposit of up to 50% may be required before ordering materials, depending on the project. The remaining balance is due upon completion unless otherwise stated in the estimate. Work will begin once the initial payment, if required, is received.
Payment Methods: We accept cash, checks, Zelle, Venmo, PayPal, and credit card (subject to a 3% processing fee for Venmo, PayPal, and credit card payments). Payment is due upon completion of services unless otherwise agreed upon in writing.
Late Fees: If payments are not made within 30 days of completion, a 9% late fee will be applied. After 60 days, T&T Handyman Services LLC will initiate legal action to recover the outstanding balance.
3. Warranty and Satisfaction Guarantee
Labor Warranty: We provide a 15-day labor warranty for plumbing, electrical, and HVAC services, which covers workmanship issues. Parts are not covered under this warranty and are subject to the manufacturer's warranty.
Satisfaction Guarantee: If you are dissatisfied with our work, please contact us within 15 days of completion, and we will address the issue to your satisfaction.
4. Client Acknowledgment of Unlicensed Handyman Services
By accepting services from T&T Handyman Services LLC, the client acknowledges that T&T Handyman Services LLC is not a licensed contractor and that the services provided may fall under the unlicensed handyman classification in California. The client agrees to hold T&T Handyman Services LLC harmless for any issues arising from the lack of licensing and understands that certain work may require specific licenses under local or state law. The client confirms that they accept this limitation and give their consent to proceed with the services.
5. Liability
T&T Handyman Services LLC carries Liability Insurance through biBERK Business Insurance. A Certificate of Insurance is available upon request. This coverage ensures that our clients are protected against damages resulting from accidents or unforeseen circumstances during the course of the work performed. However, clients are responsible for securing any additional insurance they deem necessary for their property or specific needs.
6. Licensing and Certification
T&T Handyman Services LLC is not a licensed contractor in the state of California, as there is no specific handyman license available. However, Tin Ho, the owner, is a certified HVAC technician with EPA Section 608 certification, including handling, use, and recovery of HFC-410A. For work requiring specialized knowledge or certification (such as HVAC, electrical, or plumbing), we ensure that all tasks are performed in compliance with applicable codes and safety standards. Clients should be aware that certain projects may require licensed professionals or permits, and T&T Handyman Services LLC is not responsible for work that falls outside the scope of the handyman services provided.
7. Worksite Access and Safety
The client agrees to provide safe and unobstructed access to the work area. Any hazards that may pose a risk to workers must be addressed before work begins. T&T Handyman Services LLC reserves the right to suspend work if the worksite is deemed unsafe.
8. Change Orders
Any changes to the original scope of work must be agreed upon in writing through a change order. Additional costs or time required for these changes will be discussed and approved before proceeding.
9. Completion and Final Approval
Upon completion of the work, the client will have the opportunity to inspect the job. Final approval is required before full payment is due. If any issues are identified, the client must notify us within 7 days of completion for rectification.
10. Force Majeure (Unforeseen Circumstances)
T&T Handyman Services LLC is not responsible for delays or failure to complete work due to events beyond our control, including but not limited to weather, strikes, or natural disasters.
11. Permits and Legal Compliance
Permits: For any projects totaling $1000 or more (including materials and labor), the client is responsible for obtaining all necessary permits from the city. Failure to secure the required permits may result in a stop-work order from authorities. In the event of a stop-work order, the client must pay T&T Handyman Services LLC for the work completed up to that point.
Legal Compliance: The client is responsible for all legal actions if authorities discover that work is being done without proper permits.
12. Confidentiality
Any information shared with T&T Handyman Services LLC, including personal details and project specifics, will be treated with confidentiality.
13. Right to Terminate
T&T Handyman Services LLC reserves the right to terminate any project at any time, for any reason.
14. Dispute Resolution
Disputes regarding the quality of the work or billing should be addressed within 7 days of project completion. After 7 days, no disputes will be entertained unless otherwise agreed upon. The client agrees to attempt resolution through direct communication or mediation before pursuing legal action.
15. Indemnification
You agree to indemnify, defend, and hold harmless T&T Handyman Services LLC, its owner, employees, and subcontractors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from or related to your violation of these Terms and Conditions, your use of our website or services, or any act or omission on your part that results in harm to T&T Handyman Services LLC or its clients.
16. Governing Law
These terms and conditions are governed by the laws of Santa Clara County Superior Court. Any disputes will be resolved in accordance with these laws.
17. Changes to Terms and Conditions
T&T Handyman Services LLC reserves the right to update or modify these Terms and Conditions at any time. Any changes will take effect immediately upon being posted on our website. By continuing to use our website or services after changes are posted, you agree to accept and comply with the updated Terms and Conditions.
18. Subcontractors and Licensed Partners
T&T Handyman Services LLC may partner with, or engage, licensed contractors or subcontractors to assist with certain tasks or services that require specialized expertise or licensing. In such cases, we reserve the right to engage these professionals without prior notice to the client. The scope of work and pricing may remain the same unless otherwise communicated. Any licensed contractor or subcontractor involved in your project will adhere to all applicable regulations and codes.
